AFRINIC Events Terms and Conditions


This document specifies the terms for registration and participation in an AFRINIC Event (hereinafter: Terms and Conditions).

Article 1 Definitions

In these Terms and Conditions, the following shall be understood to have the following meanings assigned to them below.

  • Event – A free-of-charge or paid activity, including onsite training courses, organised by AFRINIC on various topics relating to Internet operations and AFRINIC Services.
  • Webinar – An Event that takes place online via a third-party platform.
  • Registrant – Anyone who registers to participate in an AFRINIC Event.
  • AFRINIC – The African Network Information Centre (AfriNIC) Ltd, a company limited by guarantee having its registered office at Ebène, Mauritius.
  • AFRINIC Services – The services that AFRINIC provides to its members as well as the Internet Community, and which is published in its strategic plan available at https://www.afrinic.net/strategy.

Article 2 General

2.1 By registering to attend an AFRINIC Event, the Registrant confirms they have read, understood and agree to be bound by these Terms and Conditions.

2.2 These Terms and Conditions may be subject to amendments and will be valid after AFRINIC has informed the Registrant by participating in an Event after any changes are made to these Terms and Conditions for which the Registrant has been informed, the Registrant confirms they have read, understood and agree to be bound by these amendments.

Article 3 Registration, Participation and Cancellation

3.1. The Registrant shall register for the Event via a registration form provided by AFRINIC.

3.2 After registration, the Registrant will receive an email confirming their participation. The Registrant will be entitled to participate in the Event by receiving this confirmation.

3.3. AFRINIC will include all details necessary for participation at the Event in the confirmation email. In case of a Webinar, the link to join the Event will also be included.

3.4 In case of an onsite training course, the Registrant will be responsible for their own transport, accommodation and any other necessary travel requirements for attending it.  AFRINIC will provide Registrant with lunch and refreshments during the coffee breaks. 

3.5 The Registrant is required to bring a laptop to attend the Event, as it might be necessary for the purposes of the Event to do activities, labs, and/or quizzes.

3.6 In case the Registrant is not able to attend the Event, the Registrant will cancel their registration as indicated in the confirmation email as soon as possible and no later than three days before the Event.

Article 4 Privacy

4.1 AFRINIC is processing the personal data it collects in accordance with the applicable Mauritian data protection law and as described in the AFRINIC Privacy Policy 

4.2 By registering for an Event, the Registrant confirms their agreement with the AFRINIC Privacy Policy.

4.2 To participate in an Event AFRINIC will use the Registrant’s contact details to communicate to the Registrant all relevant information and/or updates relating to the Event they registered for. 

4.3 AFRINIC may also use the Registrant’s contact information to send announcements on new events relating to its community, learning and development activities or other news relevant to its activities. If the Registrant does not want to receive this information anymore, they can unsubscribe via the unsubscribe button at the bottom of the email (where available) or by sending an email to comms@afrinic.net or contact@afrinic.net.

4.4 AFRINIC may engage third-party service providers to assist in facilitating an Event. If for this purpose, it is required that the Registrant’s personal data is shared with them, AFRINIC undertakes to engage with third parties that offer equivalent levels of security and protection and to make any appropriate contractual and organisational arrangements so that the data shared is limited to that required for the respective purpose and is not processed for longer than necessary.

4.5 AFRINIC records the Webinars and may place the recording on afrinic.net and on our Official Social media channels. The Registrant’s name and any questions they raised during the Webinar will be part of the recording. The Registrant allows AFRINIC to use and make publicly available the Webinar’s recording where the Registrant may be included.

4.6 AFRINIC may collect and use any Event-related data to publish anonymised reports on the Event’s attendance, remote participation, providing feedback, etc.

Article 5 Liability

5.1 The Registrant indemnifies AFRINIC for any third-party claims filed against AFRINIC concerning the registration or participation at the Event or for any obligation arising from these Terms and Conditions.

5.2 AFRINIC excludes all liability for any direct or indirect damages, including damages to the Registrant, Registrant's business, loss of profit, damages to third parties, personal injury or damages to property, except in cases involving wilful misconduct or gross negligence on the part of AFRINIC.

 

5.3 AFRINIC shall not be liable for damages because of a failure to meet any obligation under these Terms and Conditions if such a failure is due to circumstances for which AFRINIC is not considered accountable by law, contract or trade custom. AFRINIC cannot be held responsible for an Event not being available in certain countries or to specific nationalities or certain individuals due to international restrictions or sanctions.

5.4 AFRINIC may cancel the Event due to unforeseen reasons beyond the control of AFRINIC. In this case, AFRINIC shall not be liable for any damages or compensation of expenses incurred concerning the Registrant's participation in the Event.

5.5 AFRINIC shall, in any event, not be accountable for failures to perform resulting from force majeure, including but not limited to unusual weather conditions and earthquakes, epidemics, terrorist attacks, governmental actions or measures and strikes.

5.6 In case a third-party tool is required during the Event for activities or quiz purposes, AFRINIC shall not be held responsible and/or liable for damages due to the Registrant’s use of this third-party tool or its improper functioning.

Article 6 Miscellaneous

6.1 The AFRINIC Code of Conduct applies to All the Events. The Registrant acknowledges, understands and agrees that Events are attended by people with different experiences, backgrounds and views. It is expected that ideas will be exchanged in a respectful manner and that everyone involved, including the Registrant, will demonstrate tolerance and respect to everyone involved with and participating in the Event at all times. If the Registrant fails to act accordingly, AFRINIC reserves the right to remove the Registrant from the Event, whether it is an onsite training course or a Webinar.

6.2 The Registrant acknowledges and accepts that any and all copyright, trademarks, database rights and other intellectual property rights subsisting in or used in connection with all AFRINIC Materials are and shall remain the property of AFRINIC. Except as explicitly provided herein or indicated for specific AFRINIC Services, AFRINIC Materials may not be used, reproduced and made available to third parties without prior written authorisation from AFRINIC. “AFRINIC Materials” are any materials contained on any webpages whose domain name include the domain name afrinic.net. AFRINIC Materials do not, however include materials on its website that are written by third parties not employed or commissioned by AFRINIC (such as mailing lists contributions). Any intellectual property rights in such materials may reside in that third party. AFRINIC is not responsible for the content of any materials created or written by such third parties.

6.3 AFRINIC Privacy Policy, including its intellectual property rights, may be revised and updated from time to time, thus forming an integral part of these Terms and Conditions.

6.4 If any provision in the Terms and Conditions is held to be invalid by a court of law, all other provisions of these Terms and Conditions will continue to be in effect and enforceable.

Article 7 Governing Law

7.1 The laws of Mauritius shall exclusively govern these Terms and Conditions. Any dispute arising out of the registration and participation of the Event shall be resolved amicably, to the exclusion of the court, through negotiation, within a reasonable period of time, and any such settlement shall be made in writing.
